TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of https://mriyadreams.com (the “Site”) and any purchase of products or services from LaMerinos.
The Site and LaMerinos brand are operated by:

Throughout these Terms, “LaMerinos,” “we,” “us,” and “our” refer to the operator identified above. “You” and “your” refer to the person accessing the Site or purchasing a product.
By accessing the Site, creating an account, placing an order, or using our services, you agree to these Terms and to any policies referenced in them.
If you do not agree, do not use the Site.
1. ONLINE STORE TERMS
You must be legally capable of entering into a binding contract to place an order.
Where you purchase on behalf of another person, organization, or child, you confirm that you are authorized to provide the relevant information and place the order.
You may not use the Site or our products for unlawful, fraudulent, abusive, or unauthorized purposes.
You may not transmit malicious code, interfere with the Site, attempt unauthorized access, or misuse any part of the service.
2. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to describe and display products accurately.
However:
• screen settings may cause colors to appear differently;
• product positioning and scale may vary slightly;
• handmade, printed, or made-to-order products may have minor production variations;
• mockups are illustrative and may not show exact physical scale;
• measurements may have reasonable manufacturing tolerances.
Minor differences that are normal for the relevant printing or manufacturing process are not necessarily defects.
Product availability, designs, sizes, colors, materials, prices, and features may change without prior notice.
3. PERSONALIZED AND MADE-TO-ORDER PRODUCTS
Many LaMerinos products are personalized or made specifically for the customer after an order is placed.
You are responsible for reviewing all submitted personalization information before completing your order, including:
• spelling;
• names;
• dates;
• times;
• measurements;
• punctuation;
• capitalization;
• color or design selections;
• any other custom text.
We will normally reproduce the information exactly as submitted, subject to technical formatting requirements.
After production begins, personalization details generally cannot be changed or cancelled.
We are not responsible for errors in personalization information submitted by the customer. This does not affect your rights where we manufacture a product incorrectly compared with the information supplied in the order.
We may contact you if personalization instructions are unclear, incomplete, inappropriate, technically impossible, or inconsistent with the selected product.
If you do not respond within a reasonable period, we may delay, cancel, or refund the order.
4. PROHIBITED PERSONALIZATION
You may not request content that:
• infringes copyright, trademark, privacy, publicity, or other rights;
• is unlawful, threatening, hateful, discriminatory, defamatory, or abusive;
• promotes violence or illegal activity;
• contains unauthorized personal information;
• could reasonably expose us or our production providers to legal liability.
By submitting text, names, images, or other content for personalization, you confirm that you have the necessary rights and permissions to use that content.
We may refuse or cancel an order containing prohibited content.
5. ORDERS
Submitting an order is an offer to purchase.
An automated confirmation means that we have received your order; it does not necessarily mean that the order has been accepted for production.
We may accept, reject, limit, or cancel an order for reasons including:
• payment failure;
• suspected fraud;
• pricing or listing errors;
• unavailable products or variants;
• technical problems;
• prohibited personalization;
• inability to manufacture or deliver the product;
• violation of these Terms.
If we cancel an order after payment has been captured, we will issue an appropriate refund to the original payment method.
6. PRICES, TAXES, AND PAYMENT
Prices are displayed in the currency shown on the Site and may change without notice.
Applicable taxes, delivery charges, and other costs will be displayed at checkout where required.
You agree to provide current, complete, and accurate billing and payment information.
Payment is processed through Shopify Payments or another payment provider offered at checkout. Your use of a payment service may also be subject to that provider’s terms.
Promotional prices, discount codes, and offers:
• may be limited by time, product, region, or customer;
• cannot be exchanged for cash;
• may not be combined unless expressly stated;
• may be cancelled where obtained through misuse, fraud, or technical error.
7. PRODUCTION AND SHIPPING
Production and delivery estimates are estimates, not guaranteed delivery dates, unless expressly agreed otherwise.
Most products are produced after an order is placed. Production and delivery times can be affected by:
• personalization review;
• seasonal demand;
• print-provider capacity;
• carrier delays;
• weather;
• customs;
• incorrect addresses;
• events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address.
If an order is returned or lost because the customer provided an incorrect or incomplete address, additional production or shipping charges may apply.
Risk and ownership transfer according to applicable consumer law and the delivery terms shown at checkout.

8. RETURNS, CANCELLATIONS, REPLACEMENTS, AND REFUNDS
Returns, refunds, replacements, and cancellations are governed by our Refund Policy and applicable consumer law.
Because personalized and made-to-order products are created specifically for the customer, they may not be eligible for return or cancellation due solely to:
• a change of mind;
• an incorrect size selected by the customer;
• incorrect personalization submitted by the customer;
• a preference change after production has begun.
This limitation does not remove any mandatory rights relating to products that are defective, damaged, materially different from the order, or incorrectly produced.
If an item arrives damaged, defective, or incorrectly produced, contact support@mriyadreams.com within the period stated in our Refund Policy and include:
• your order number;
• a description of the issue;
• clear photographs of the item and packaging where relevant.
Do not return a product without first contacting us and receiving instructions.
9. INTELLECTUAL PROPERTY
The Site and its content, including illustrations, artwork, graphics, photographs, product designs, text, logos, branding, videos, layouts, and downloadable materials, are owned by or licensed to LaMerinos and are protected by applicable intellectual property laws.
Purchasing a physical or digital product does not transfer copyright or other intellectual property rights.
Unless a product listing expressly grants additional rights, products and content are for personal, non-commercial use only.
You may not, without prior written permission:
• reproduce, copy, distribute, sell, sublicense, or commercially exploit our designs;
• upload our artwork to print-on-demand or resale services;
• remove watermarks or rights notices;
• use product images to advertise unrelated goods;
• train, develop, or improve an artificial-intelligence model using our artwork or product content;
• create substantially similar commercial derivatives;
• scrape or systematically collect Site content.
10. CUSTOMER CONTENT
Where you submit reviews, photographs, comments, feedback, or other content, you retain ownership of your original content.
You grant us a non-exclusive, worldwide, royalty-free licence to use content that you intentionally submit for publication or marketing, solely to operate, promote, and improve LaMerinos, unless you withdraw permission where applicable.
We will not publicly use a customer’s private personalization information, child’s full name, birth information, or private photographs for marketing without appropriate permission.
11. THIRD-PARTY SERVICES
The Site is hosted by Shopify and may rely on third-party services including Printify, print providers, payment processors, carriers, analytics providers, and social media platforms.
Third-party services may have their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
Links to third-party websites are provided for convenience and do not necessarily constitute endorsement.
12. PINTEREST, ETSY, AND SOCIAL MEDIA INTEGRATIONS
LaMerinos may use private internal software tools to manage its own products and original content across Shopify, Etsy, Pinterest, Instagram, Facebook, and similar platforms.
“Social Automation Lamerinos” is an internal content-management application used to:
• manage our own Pinterest Pins and boards;
• prepare and schedule original product content;
• link content to LaMerinos product pages or marketplace listings;
• retrieve analytics concerning our own content;
• reduce duplicate publication.
These internal integrations are not offered to customers as public software or a subscription service.
Pinterest, Etsy, Shopify, Meta, Instagram, and Facebook are independent third-party platforms. LaMerinos is not endorsed by or affiliated with those companies unless expressly stated.
Use of their platforms remains subject to their respective terms and policies.
13. ACCURACY OF INFORMATION
We aim to keep Site information accurate, but information may occasionally contain typographical errors, inaccuracies, or omissions relating to:
• product descriptions;
• pricing;
• promotions;
• shipping;
• availability;
• personalization options.
We may correct errors, update information, or cancel an affected order where legally permitted.
14. ACCEPTABLE USE
You may not:
• use the Site for unlawful or fraudulent purposes;
• impersonate another person;
• submit false order or payment information;
• attempt to interfere with Site security;
• introduce viruses or malicious code;
• scrape or extract content through unauthorized automated methods;
• overload or disrupt the Site;
• use the Site to infringe another person’s rights;
• abuse customer support or initiate fraudulent payment disputes.
We may restrict access or cancel orders where we reasonably believe these Terms have been violated.
15. DISCLAIMER OF WARRANTIES
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
To the fullest extent permitted by law, the Site and its general informational content are provided on an “as available” basis.
We do not guarantee that:
• the Site will always be uninterrupted or error-free;
• all defects will be corrected immediately;
• third-party services will remain available;
• use of the Site will achieve a particular commercial, decorative, or personal result.
Product-specific rights remain governed by applicable consumer law and our published policies.
16. LIMITATION OF LIABILITY
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, fraudulent misrepresentation, or other liability that applicable law prohibits us from excluding.
To the fullest extent permitted by law, LaMerinos will not be liable for indirect, incidental, special, or consequential losses arising from use of the Site or circumstances outside our reasonable control.
Where liability may lawfully be limited, our aggregate liability relating to a product order will not exceed the amount paid for the affected order.
These limitations do not reduce mandatory consumer rights.
17. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify LaMerinos against claims, losses, or expenses arising from:
• content that you submit without necessary rights;
• unlawful use of the Site;
• fraud or intentional misuse;
• violation of another party’s intellectual property or privacy rights;
• material breach of these Terms.
This section does not apply where prohibited by consumer law.
18. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws applicable to the business operator identified above, without depriving consumers of mandatory protections available in their country of residence.
Before beginning formal proceedings, you agree to contact us at [EMAIL] so that we can attempt to resolve the matter.
Consumers in the European Union may also have access to local courts, consumer-protection authorities, or alternative dispute-resolution procedures as provided by applicable law.
19. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in the Site, products, services, technology, or law.
The version published at the time of an order will normally apply to that order, except where a change is required by law.
The latest version will be posted on this page with its updated date.
20. SEVERABILITY
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or removed, while the remaining provisions will continue in effect.
21. NO WAIVER
Failure to enforce a provision of these Terms does not waive our right to enforce it later.
22. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and any product-specific conditions shown on the Site, form the agreement between you and LaMerinos concerning use of the Site and purchases made through it.
